Candidate Trial Agreement

1. Purpose of Trial
This agreement sets out the terms that apply during a candidate’s trial period with a family. The trial is intended to allow both the Client (Family) and the Candidate (Nanny) to assess suitability before entering into any ongoing arrangement.

2. Duration of Trial
The trial period will commence on the agreed start date and continue for the agreed number of trial sessions, unless ended earlier by either party.

3. Compensation
3.1 The Candidate shall be paid for all trial hours worked at the agreed hourly rate.
3.2 Any trial exceeding one (1) hour shall be deemed a paid trial, and the Candidate is entitled to payment for the entire time worked.
3.3 Payment must be made at the conclusion of each trial session unless otherwise agreed in writing.

4. Confirmation in Writing
All trial arrangements, including date, time, location, and hourly rate, must be confirmed in writing between the Client, the Candidate, and/or the Agency prior to the commencement of the trial.

5. Client Responsibilities
The Client agrees to:

  • Provide a safe and appropriate working environment.
  • Adhere to agreed trial hours.
  • Treat the Candidate with respect and fairness during the trial process.

6. Candidate Responsibilities
The Candidate agrees to:

  • Attend trial sessions on time and perform their duties to a professional standard.
  • Notify the Client and the Agency as soon as possible if unable to attend a trial due to illness or other valid reason.

7. Confidentiality
Both parties must maintain confidentiality regarding each other’s personal information during and after the trial.

8. No Guarantee of Ongoing Engagement
Participation in a trial does not oblige either party to enter into an ongoing engagement. Any continuing arrangement must be documented in a separate written contract.

9. Governing Law
This agreement is governed by the applicable workplace and contractual laws of Australia.
