Terms and Conditions

1. Introduction

  1. The Australian Nanny Agency ('Agency') acts as an agent to introduce suitable employees (“Candidates”) to work as nannies, travel nannies, maternity nurses, governesses, teachers/tutors, house managers, personal assistants, personal trainers, chefs and any other domestic staff for its families ('Client'). The Agency does not employ any of the Candidates, directly or indirectly. Candidates are introduced to Clients on the basis that they will be employed by the Client.

  2. Clients undertake to notify the Agency immediately upon any offer being made which results in the engagement of a Candidate.

2. General

  1. These terms and conditions are non-negotiable and by interviewing and subsequently employing a Candidate introduced by the Agency, the Client is considered to be in agreement with these terms and conditions.

  2. All visa/immigration formalities, travel expenses, tax & social security payments, contracts and medical cover are the sole responsibility of the Client.

3. Fees

INTERNATIONAL

  1. Registration Fee

  • A Registration Fee of US$300 is payable on all positions advertised.
  • The Registration fee is non refundable under all circumstances.
  • The Registration fee is payable on registration.
  • If the Client wishes to make changes to the days/times/start date/job description from their initial registration, another US$300 Registration Fee will apply.
  1. Placement Fees

Permanent Placements (12 Months)

  • The Agency’s placement fee is 16% of the employees net annual salary.
  • The placement fee includes a 4 week trial with the Candidate
  1. Short Term Contracts

International Maternity Nurse (Maximum 3 months)

  • Placement fee of US$60 per day is payable in advance.
  • Maternity nurse placements are for a maximum term of 3 months. Anything longer than this is a permanent placement and the fee scheduled listed in 2b applies.

Temp roles & Trials (Maximum 6 weeks)

  • Placement fee of US$60 per day payable in advance.
  • Temporary roles and trials require a minimum wage of AUD$2000 net per week and a return flight booked.
  • Temporary roles and trials are available for a period of up to 6 weeks. Anything longer than this is a permanent placement and the fee scheduled listed in 2b applies.
  1. We do not, under any circumstances offer refunds or replacements for any short term contracts.

  2. Placement fees are payable by bank transfer or by credit card to the Agency. The placement fee is due within 7 days of the date of invoice. Under no circumstances will extensions be given. Failure to comply with these conditions will result in the Candidate being referred to another Client.

AUSTRALIAN PLACEMENTS

  1. Registration Fee

  • A Registration Fee of $165 is payable on all positions advertised.
  • The Registration fee is non refundable under all circumstances.
  • The Registration fee is payable on registration.
  • If the Client wishes to make changes to the days/times/start date/job description from their initial registration, another $165 Registration Fee will apply.
  1. Placement Fees

  • The Agency’s placement fee:
    - Full time (31+hours per week) $2200
    - Part Time (up to 30 hours per week) $1650
    - Temporary/contract (3 months max) 
  • This includes a 4 week trial period with the nanny (excluding temp/contract roles)
  • If the client is unhappy during this trial period, Australian Nanny Agency will recruit one more nanny at no extra cost.
  • Placement fees are payable by bank transfer or by credit card to the Agency. The placement fee is due within 7 days of the date of invoice. Under no circumstances will extensions be given. Failure to comply with these conditions will result in the Candidate being referred to another Client.

4. Additional Fees

  1. If the Client wants to extend any placement of a Candidate, from a short term/ temporary position to a full-time position for a further period of time, the Client must pay the Agency the full placement fee.

  2. If the Candidate is solicited to work for the client with the intention of bypassing the agency fees - in the event where the Client does not hire a Candidate following the initial introduction by the Agency but approaches the Candidate directly (not through the Agency) offering employment, then the Client shall be liable to pay the full Agency Placement Fee plus 30% penalty surcharge.

5. Cancellation

  1. If a Client withdraws an offer of confirmed employment or cancels the confirmed booking prior the Candidate's start date, the placement fee will not be refundable and no replacement will be provided.

6. Replacement Policy

  1. The Agency fees are non-refundable. Should the Candidate leave or the Client be unhappy with the Candidates performance within 4 weeks from commencing employment, the Agency will offer ONE replacement Candidate free of charge. The Agency will endeavour to find a suitable replacement and present the Client with a minimum of 4 Candidate portfolios. The agency accepts no liability and is not obliged to offer a Replacement or any refund if the Client finds the portfolios unacceptable and does not want to engage any of the potential Candidates.

  2. Replacements must be used immediately and cannot be used at a later date.

  3. Replacements do not apply for temporary or trial positions.

  4. If the Candidate cancels an accepted placement prior to the commencement date with the Client, the Agency agrees to provide a substitute Candidate of similar qualifications without further payment of the registration fee or placement fee (if already paid by the Client).

  5. If the Candidate terminates their employment contract with the Client at any time because the Client has breached the terms contained in the employment contract between the Client and the Candidate or has violated corresponding labour and/or civil /federal laws (including but not limited to, violence against children, violence against the Candidate, insulting or threatening the Candidate), or has provided an unsafe or hazardous work environment, the Agency will not be held responsible for the acts or omissions of the Candidate and will not provide the Client with a replacement Candidate.

  6. The Agency will offer replacements if the following conditions have been satisfied:

    • The Client paid the full registration fee prior to the interview commencement.
    • The Client has paid for the placement fee in full within seven days from the invoice date and prior to the Candidate's start of employment.
    • The Client has notified the Agency of the termination of employment of a candidate in writing within 7 days of termination.
    • The Candidate has not cancelled the engagement due to unreasonable requirements by the Client.
    • The Client has not changed the employment conditions, such as working hours, location of employment and duties as originally agreed by the Candidate and Client in the contract.
    • The Candidate's working conditions and/or the way the Client treated the Candidate were satisfactory.
    • The Client was not physically or verbally aggressive towards the Candidate or Agency's representative.

7. Confidentiality & Suitability

  1. All introductions of Candidates by the Agency and their personal details shall be kept strictly confidential by Clients. Clients undertake not to disclose any introductions to third parties. Any breach of this undertaking resulting in the employment of a Candidate by a third party will result in the Client liable for full payment of the Agency's registration and placement fee.

  2. The Agency uses its reasonable endeavours to establish the suitability of any Candidate for introduction to the Client. However, all responsibility for ascertaining the suitability of any Candidate for the engagement remains with the Client. Clients are encouraged to perform their own suitability checks on the Candidates before engaging them in employment. The Agency does not accept under any circumstances and excludes liability for any accident, loss, damage, misconduct, expenses incurred or suffered by the Client or their children allegedly arising from the acts of the Candidates introduced by the Agency. Australian Nanny Agency act as the Agent for the client and not as the Employer for the Candidate. The Client agrees that Australian Nanny Agency be excluded from any responsibility should any incident occur.
